By using FitCommit ("the App"), you agree to be bound by these Terms of Service. Please read them carefully before using our services.
1. Acceptance of Terms
By creating an account or using the App, you confirm that you are at least 18 years old and agree to these Terms. If you do not agree, do not use the App.
2. Commitments and Pledges
When you create a commitment, you agree to:
- Select an activity type, weekly workout target, commitment duration (4 weeks to 1 year), and a points pledge amount
- Complete the specified fitness goal each week for the duration of the commitment
- Verify activities honestly through the App's photo and location verification
- Accept that pledged points will be deducted if you fail to meet your weekly goal
Commitments use a virtual points system. Points have no monetary value and are used solely for gamification and leaderboard ranking. Points are earned by completing verified activities and deducted when weekly goals are missed.
3. Activity Verification
All activities must be verified through the App using:
- A photo taken at the time of the activity showing your presence
- Location data to confirm you are at a gym or sports facility
- A selected workout duration for accurate activity logging
We use AI analysis (Google Gemini) to evaluate photo submissions and Google Places to verify your location. Verification decisions are final. Deliberately submitting fraudulent photos or manipulating location data may result in account termination.
4. FitCommit Pro Subscription
FitCommit offers a "FitCommit Pro" auto-renewable subscription that unlocks Leaderboard and Social Pacts features.
- FitCommit Pro Monthly: $5.99 per month
- FitCommit Pro Yearly: $59.99 per year
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- You can manage and cancel subscriptions in your device Settings > Apple ID > Subscriptions.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
5. Refund Policy
Subscription refunds are handled directly by Apple in accordance with their refund policies. Please contact Apple Support for any refund requests regarding your subscription.
6. Commitment Cancellation
Active commitments cannot be cancelled once started. The commitment will run for the duration you selected at creation. You may:
- Choose not to create new commitments after the current one expires
- Let commitments expire at their end date
- Delete your account (note: any pending weekly evaluations will still be processed)
7. Pacts (Social Challenges)
Pacts are a FitCommit Pro feature. When participating in pacts:
- Both parties must accept the challenge before it begins
- Point stakes and terms are agreed upon before starting
- Users who meet their goal earn 2 bonus points upon pact completion
- Outcomes are determined automatically based on verified activity data
8. Virtual Currency (Points)
FitCommit uses a virtual currency ("Points") for gamification purposes only. Points:
- Have no real-world monetary value
- Cannot be exchanged for cash, goods, or services
- Are earned through verified activities and pact completions
- Are deducted when you miss a weekly commitment goal
- Are used to track progress, determine rank, and populate leaderboards
9. Permissions
The App requires Camera and Location permissions to function. Camera access is needed to take verification photos of your workout. Location access is needed to confirm you are at a fitness venue. You may revoke these permissions at any time through your device settings, but core verification features will not work without them.
10. Account Termination
You may delete your account at any time through the App settings. We may suspend or terminate accounts for:
- Violation of these Terms
- Fraudulent activity submissions or location spoofing
- Abuse of the App or harassment of other users
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- FitCommit is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to amounts you paid us in the past 12 months
- We are not responsible for injuries sustained during fitness activities
- You assume all risk associated with your fitness activities
12. Disclaimer
FitCommit is a motivational and accountability tool, not a fitness program or medical service. Consult a healthcare provider before starting any exercise routine. We do not provide medical, fitness, or financial advice.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the App will be resolved through:
- First, informal negotiation by contacting pickitbox.official@gmail.com
- If unresolved after 30 days, binding arbitration
- Arbitration will be conducted in accordance with AAA rules
- You waive the right to participate in class actions
14. Intellectual Property
All content, features, and functionality of the App are owned by FitCommit and protected by copyright and trademark laws. You may not copy, modify, or distribute our content without permission.
15. Changes to Terms
We may update these Terms at any time. Continued use of the App after changes constitutes acceptance. Material changes will be notified through the App or email.
